Privacy (transparency) notice pursuant to General Data Protection Regulation Articles 13 and 14

Zakuna Architectural Products Ltd is a business directed mainly at individuals, and some corporate subscribers, who wish to engage with us in connection with the purchase or possible purchase of architectural products. We abide by the relevant rules of the General Data Protection Regulation (“GDPR”), the Data Protection Act 2018 and the Privacy and Electronic Communications (EC Directive) Regulations 2003.

This notice is intended for individuals with whom we deal in our business.  It is not intended for our employees. We categorise those individuals (“data subjects”)as follows:

Corporate Subscribers—deal with us in their capacity as employees or owners of businesses which have other employees.

Individuals—consumers interested in our products.

We take the protection of your personal data very seriously. This privacy notice explains what information we collect from you, where it comes from, what we do with it, how we keep it secure and the circumstances in which we provide it to third parties.

In most circumstances your data will only be processed within the UK or EEA. We do however use certain data processing services (data back up and hosting service) provided by third parties who provide their services from overseas and this may involve overseas transfers of our personal data. Other jurisdictions may not be as protective of personal data as the UK or EEA so we ensure the protection of your data with appropriate contractual provisions. If for any reason we need to transfer your data outside the UK/EEA for any other purpose we will inform you of that, any privacy risks involved and what we have done to minimise those risks.

You can at any time ask us to tell you what personal data relating to you we hold.

You also have the right to ask us to rectify your data if it is inaccurate, erase it or restrict the processing of it. In some circumstances you can ask us to provide it to you in a format which would allow you to transfer it digitally to another.

Where we have requested and you have given us consent to process your data you may withdraw that consent at any time.

Were our business to be sold all your data would be transferred to the purchaser so that they could use it in the same way as we do now.

Individual

Source of data. Any data we have about you will have been provided by you.

Customer Data. As a potential buyer of our products we collect certain data from you:

  • Name.
  • Contact Details.
  • Postcode.
  • Telephone number.
  • Email address.

We may also collect data about your visits to our website and the pages that you viewed.

Purpose. We process your data in order to contact you and provide information on our products that you have specified you are interested in. We continue to process that data if you further engage with us and proceed to purchase a product.

Legitimate Interest.  We have a legitimate interest in doing that because you have asked us to do it. It may also be necessary to allow us to fulfil our contractual obligations to you.

Consent.  We only need your consent to send you marketing communications. You can withdraw that consent at any time. If you have not already done so, please give us that consent here.

Marketing. We will only send you marketing material about services other than those that we have previously provided to you, or discussed with you, with your consent. That consent can be withdrawn by you at any time. Click here to revoke your consent to receiving any marketing material from us.

Those with whom we share it. Some of our data, which could include your personal data, is stored off site by third parties. We may share your personal data with any member of our group, which means our subsidiaries, our ultimate holding company and its subsidiaries, as defined in section 1159 of the Companies Act 2006.

We ensure that those with whom we share such data have adequate data privacy policies and contracts. If any of it is processed outside of the UK/EEA (where data protection laws may not be as strong as in the UK/EEA) we ensure that appropriate safeguards are in place.

Retention. Your data will be retained in our systems for up to 2 years after our last contact from you.

Why we need your data. Without your data we would not have the information necessary to contact you with details of our products.

Overseas transfers.

We do not intentionally transfer any of your personal data to outside the UK/EEA (where data protection laws may not be as strong as in the UK/EEA) but are aware that some third parties with whom we deal may hold it or place it in or transfer it through such countries. In those circumstances we ensure that appropriate safeguards are in place.

Corporate Subscriber

Customer Data. As an individual acting on behalf of a commercial entity (a so called “corporate subscriber”) we collect certain data about you:

  • Name and work address.
  • Email address.
  • Telephone numbers.

We may also collect data about your visits to our website and the pages that you viewed.

Purpose. We process your data in order to contact you in your business capacity and to record our contacts with you.  

Legitimate Interest. We have a legitimate interest in doing that because your organisation and you want us to be able to deal with you.

Consent.  We do not need your consent to process your data in this way but we would stop doing so if you, or your employer, was to ask us to do so.

Marketing. Although it is unlikely as we generally only market to individuals, we may send you marketing material relevant to your business and we have a legitimate interest in doing so. We do however provide an opt-out in case you no longer wish to receive marketing communications. A link to “unsubscribe” should be found on each marketing communication and can be found here.

Why we need your data. Without your data we would not have the information necessary to deal with you nor a full record of our dealings with you or your organisation.

Where we get it. Most of your data held by us will have come from you. Some may have been provided by e.g. your employer or colleagues.

Overseas transfers. Where we are working or intend to work together with third parties outside the UK/EEA we will need to transfer some of your data to them so that they can deal with you. Jurisdictions outside the UK/EEA may not have the same level of safeguards for personal data as the UK/EEA and we will be unable to take any special measures to protect your data once transferred. In our view the relevant data privacy legislation is not intended to require us to take any special measures in these circumstances.

Other than as above we do not intentionally transfer any of your personal data to outside the UK/EEA but are aware that some third parties with whom we deal may hold it or place it in or transfer it through such countries. In those circumstances we ensure that appropriate safeguards are in place.
